Event Release

The undersigned hereby makes the following representations: (i) that the undersigned understands that the sport of curling is played on ice and requires physical fitness; (ii) that the undersigned possesses such physical fitness; and (iii) that the undersigned understands that the risks of participating in any curling activity could involve serious injury or death.

In consideration of being allowed access to the Tulsa Ice Centers (as defined below) as a participant in any curling activity in the Tulsa Ice Center, I, the undersigned, for myself and my estate, successors, heirs, beneficiaries, administrators, trustees, representatives, and attorneys do hereby remise, release, acquit, and forever discharge (i) Tulsa Ice Centers, LLC, an Oklahoma Limited Liability Company (the “TIC”); (ii) Tulsa Curling Club (TCC); (iii) the respective successors and assigns or each of the TIC and TCC and (v) the respective employees, officers, and directors, but only while acting in their capacity as such, of each of the TIC and TCC, the (“Releasees”) from any and all actions, causes of action, claims, demands, and liabilities, both in law and equity for damages and any court costs and legal expenses and fees associated therewith in respect of physical, mental, and bodily injury occurring to me while participating in only curling activity in the Tulsa Ice Centers.

Should any of the provisions under this release, or part thereof, prove to be or become invalid, validity of the remaining provisions of the release shall not be attached. The Tulsa Ice Centers shall mean either of the following: (1) The room containing 3 sheets of ice in which the sport of curling is played in the building located at 6413 South Mingo Road Tulsa, OK 74133 rented and operated by the TIC or (2) the room containing 5 sheets of ice in which the sport of curling is played in the building located at 4143 S Yale Ave, Tulsa, OK 74135 rented and operated by the TIC.

The Expiration Date shall mean the date which is one (1) calendar year after the date this Release is executed below. I certify that I am at least eighteen (18) years of age and have the legal capacity to execute this Participant Release on my own behalf. I hereby revoke any and all releases of liability, waivers, and indemnifications previously executed by me in favor of any of the Releasees.

The Tulsa Curling Club is an Oklahoma not-for profit corporation registered as a 501(c)3 tax exempt organization. The Club coordinates curling activities for people of all ages by offering instruction, training, practice, and league play. The Club frequently takes photos and videos of attendees and participants at events or activities to share on the website, social media, and other uses.

I hereby grant The Tulsa Curling Club permission to use my image, likeness and sound of my voice as recorded on any photography, audio, or video medium (collectively “Recordings”) without payment or any other consideration. This permission is limited to use by The Tulsa Curling Club; the Recordings may not be sold to third parties without my written permission. I understand that my image may be edited, distorted, copied, displayed with text, exhibited, published or distributed and waive the right to inspect or approve the draft or finished product of Recordings. I waive any right to royalties or other compensation arising from or related to the use of Recordings and relinquish any rights I may have or acquire in the Recordings.

I understand this permission signifies that Recordings of me may be displayed in print or electronic media, including via the Internet, social media, a public setting, television, or other publication. You may request that The Tulsa Curling Club stop using a Recording of you, but such request does not obligate The Tulsa Curling Club to comply with the request, or to find, retract, delete, or destroy Recordings.
